ACB Chargesheets 10, Including 7 SMC Officers, Over Illegal Construction in Batamaloo

Srinagar, Aug 17, KNT: The Jammu and Kashmir Anti-Corruption Bureau has filed a chargesheet against 10 persons, including seven officers of the Srinagar Municipal Corporation and three private individuals, in a case concerning alleged illegal and unauthorized construction in Ward No. 28, Batamaloo, near Tiny Hearts School at Tengpora.
The chargesheet in FIR No. 06/2023 registered at Police Station ACB Srinagar was produced before the Special Judge Anti-Corruption, Srinagar, for judicial determination.
According to the ACB, the case concerns allegations that officials posted in Ward No. 28 of the Srinagar Municipal Corporation allegedly abused their official positions and entered into a criminal conspiracy with a private beneficiary, identified as Reyaz Ahmad Dar, son of Abdul Rahim Dar, resident of Tengpora Batamaloo, to facilitate and allow unauthorised construction near Tiny Hearts School.
The accused have been chargesheeted under Section 5(1)(d) read with Section 5(2) of the J&K Prevention of Corruption Act Samvat 2006, Section 120-B of the Ranbir Penal Code, Section 4-A of the RD Act and Section 9-A read with Section 20 of the Evacuees (Administration of Property) Act, 1949.
The ACB said its investigation was based on oral and documentary evidence and claimed that the allegations against the accused public servants and private beneficiaries were substantiated during the probe.
The case also involves allegations of misuse of official position and extending undue benefit to private beneficiaries in connection with the construction.
The ACB said the requisite sanction for prosecution of the public servants was obtained from the Government before the chargesheet was presented before the court.
The court will now examine the evidence and determine the charges against the accused in accordance with law. [KNT]
